For reasons of better readability, the simultaneous use of the language forms male, female and diverse (m/f/d) is avoided. All personal designations apply equally to all genders.
- General applicable
1.1. These General Terms and Conditions (GTC) apply to the relationship between the customer and Wiener Nimmerland (contractor or simply called "we/us").
1.2. However, any agreements made between the customer and us may deviate from the General Terms and Conditions. If there are any agreements that deviate from these terms and conditions, this does not result in the invalidity of the entire contract.
- Booking and conclusion of contract
2.1. The booking of a tour entered in the appointment calendar of Wiener Nimmerland can be completed by online booking (independent booking directly via the website, with selection of the date and subsequent immediate confirmation of the booking), e-mail, telephone call or online contact form. The booking of an appointment outside of the fixed dates offered can be completed by email, phone call or web form and is only offered for bookings of 2 or more people.
2.2. A booking will be confirmed by email to the customer no later than 24 hours after receipt of the booking.
2.3. The booking represents a binding contractual declaration.
- Payment
3.1. Various payment options are available to the customer to pay for the booking. The customer can pay online with a credit card, PayPal, Google Pay, Apple Pay or by direct transfer via Klarna or EPS. Furthermore, the costs can be paid by independent bank transfer or cash payment on site. If payment is not made in cash directly on site, the total costs must be paid no later than 3 days before the booked date. If the payment is not received on time, the booking will be canceled [see point 7.].
3.2. Payment can be made either online, by bank transfer or in cash on site. Payment by credit card is made directly through our website. You will be forwarded securely for payment with PayPal, Klarna, EPS, Google Pay or Apple Pay. Payment by independent bank transfer is made through your bank.
3.3. If the customer decides to use the "Pay later" payment method for the independent transfer, the payment request will be sent to him by e-mail no later than 24 hours after booking, including the data relevant to the payment.
3.4. The customer can also select cash payment on site with the "Pay later" payment method. The customer must notify us of the desire to pay in cash in good time. Either state this directly when booking in the “Note/Remarks” field or by e-mail. When paying cash on site, the customer receives a cash receipt.
However, we reserve the right to no longer agree to cash payments for the rest of the year from a certain point in time at which, according to the cash register obligation, the permitted annual income in cash is exceeded.
3.5. If the customer has not booked online (but by e-mail, phone call or online contact form), either the forwarding to the payment function or the data relevant for the transfer will be sent to him by e-mail together with the booking confirmation. The button labeled "Pay Now" redirects to our website https://www.wienernimmerland.at and enables direct and secure payment by credit card, PayPal, Klarna, EPS, Google Pay or Apple Pay.
3.6. In the case of companies, an invoice will be issued automatically or otherwise upon request (in addition to the integrated invoice in the booking confirmation).
- Services
4.1. The scope of the contractually agreed services results from the service description of Wiener Nimmerland. This can be found in full on the website or summarized on the booking page. The key data of the booking (date, duration, start and end point) are also included in the booking confirmation.
4.2. The booked activities take place in any weather. In extreme weather conditions, such as over 30°C in the shade or heavy rain and thunderstorms, it can be adjusted at the request of the participants. For example, the tour can take place mostly in shaded areas when it is hot, or in a pub or other dry area when it rains heavily.
4.3. Definition of the services offered:
4.3.1. City walk/tour: The guided city walk takes place outdoors and you move from station to station on foot.
4.3.2. Addiction prevention lecture: The lecture takes place on site at the school that booked the offer. If desired, it can also take place outdoors in Vienna.
- Liability
5.1. Wiener Nimmerland is liable for the proper provision of the service contractually agreed in advance.
5.2. Wiener Nimmerland is not liable for an unplanned interruption or delay in the tour if the reason for this is beyond our control (weather, unexpected construction work, police action). In this case, the tour guide is entitled to change the route of the city tour accordingly, or in extreme cases to interrupt or cancel the tour if it is not possible to carry it out safely.
5.3. The tour leads over public roads and mostly asphalt. It also leads through parks and shortly before the end over a staircase (which can also be bypassed if the participants wish).
5.4. Participation in the tours is entirely at the participants' own risk. The participants must judge for themselves and under their own responsibility and decide whether they are able to participate in the tour based on their own (physical) condition. If these decisions are based on misjudgments, the responsibility for this lies solely with the respective participants.
5.5. Wiener Nimmerland cannot accept any liability for damage of any kind.
- Start time of the tour
6.1. The tour starts at the agreed time.
6.2. If the tour was booked by a group, the tour guide is willing to wait for the whole group 15 minutes from the official start time. After that, the tour is considered canceled and no costs will be refunded.6.3. If the tour guide is more than 10 minutes late, the customer has the choice of waiting for the tour guide, booking another appointment or canceling free of charge. In case of cancellation, the full amount will be refunded.
- Rebooking and cancellation conditions
7.1. Up to 24 hours before the start of the tour, the customer has the option of rebooking to another date or canceling the booking free of charge. If the rebooking is made after this deadline, but no later than 6 hours before the booked time of the tour, a fee of 30% of the booking price for the additional processing work must be paid. If the cancellation occurs after this period, the cancellation fee is 100% of the booking price.
7.2. With the booking confirmation by e-mail, every customer has the option to change or cancel the booking independently [point 7.1 applies here]. In this, the button with the inscription "View/edit tour" redirects to our website https://www.wienernimmerland.at and enables the customer to change the number of people, to move the date to any other fixed date or to cancel the tour.
7.3. The customer can also make the rebooking by phone call, e-mail or web form. If the customer would like to rebook to an appointment outside of the appointment calendar (no fixed appointment), this can only be achieved by phone, e-mail or web form [see point 2.1.].
7.4. The customer can also cancel by email or web form. In any case, the cancellation must be made in writing.
7.5. In addition to rebooking and cancellation, there is also the option of requesting a voucher for the total amount of the booking. This is valid for 1 year from the date of issue and can be used at a later date to book a tour on any date.
7.6. Wiener Nimmerland has the right to postpone or cancel the agreed tour up to 3 days before the date of the tour. Customers will be informed immediately and can choose between free cancellation or rebooking of the appointment.
7.7. In exceptional cases, Wiener Nimmerland is entitled to cancel the tour up to 4 hours before the start time. Customers will be informed immediately and can choose between free cancellation or rebooking of the appointment.
- Choice of law
8.1. The place of fulfillment of the contract is the place where the tour takes place.
8.2. The place of jurisdiction is Vienna.
8.3. Austrian law applies to the contractual relationship between the customer and Wiener Nimmerland.
