For reasons of better readability, the simultaneous use of the language forms male, female and diverse (m/f/d) is avoided. All personal designations apply equally to all genders.
1. General information
1.1. These General Terms and Conditions (GTC) govern the contractual relationship between the customer and Wiener Nimmerland (hereinafter "we" or "us").
1.2. Individual agreements between the customer and us may deviate from these Terms and Conditions. Such deviations do not affect the validity of the remainder of the contract.
2. Booking and conclusion of contract
2.1. Tours with Wiener Nimmerland can be booked online, by email, or by phone. Fixed dates are available. For groups of four or more people, a customized date can also be booked.
2.2. For Nico's Tour, the booking is initially considered a non-binding inquiry. After checking availability, Nico will confirm the date. Within 48 hours of receiving the inquiry, the customer will receive either a booking confirmation, a cancellation, or a suggested date change based on Nico's availability via email.
2.3. For Martins Tour, the customer will automatically receive a booking confirmation by email after booking.
2.4. Lectures can be requested online, by email, or by phone. They are aimed at school classes and groups and can be booked per school class.
2.5. Booking a lecture initially constitutes a request. After checking the availability of the speaker and the suitability of the venue in terms of distance, the customer will receive a confirmation or cancellation via email.
2.6. A binding contract is concluded upon receipt of the booking confirmation.
3. Payment
3.1. Various payment options are available to the customer: credit card, PayPal, instant bank transfer (Klarna or EPS), bank transfer, or cash payment. The full amount must be paid no later than two weeks after the tour date.
3.2. Payments by credit card are made directly through our website. For payments via PayPal, Klarna, or EPS, the customer is securely redirected to the respective payment provider. Independent transfers are made through the customer's bank.
3.3. When booking online through our website, all payment methods listed under section 3.1 are available. You can pay directly online during the booking process or select the "Pay later" option to pay by bank transfer or in cash.
3.4. When booking by email or telephone, payment is made by bank transfer or cash. If the customer wishes to use an online payment method (see 3.1), a link to this method can be sent to them via email upon request. The button labeled "Pay Now" redirects to our website https://wienernimmerland.at and allows payment by credit card, PayPal, Klarna, or EPS.
3.5 If the customer selects the "Pay Later" option during the online booking and decides to make a bank transfer, they will find the required account details in the booking confirmation, in the FAQs, or on the invoice. Upon request, we can also send them by email.
3.6. If the customer selects the "Pay Later" option during the online booking and wishes to pay in cash on-site, this request must be indicated during the booking process and entered in the "Note/Remarks" field. Wiener Nimmerland reserves the right to refuse cash payments.
3.7. For each booking, an invoice will be automatically generated and sent via email after the tour has been completed. Upon customer request, the invoice can also be issued in advance.
3.8. Culture Pass holders can participate in one tour free of charge. A maximum of two places are available per tour. Bookings can be made via the website, email, or phone. When booking online, please indicate "Culture Pass" in the "Reservation" field and select "Pay Later" as the payment method.
4. Services
4.1. The scope of services is determined by Wiener Nimmerland's service descriptions, which are fully available on the website and the booking page. Selected services are also occasionally bookable via TripAdvisor and are also described there. The key booking details (date, duration, tour, start and end points) are also included in the booking confirmation.
4.2. The booked activities will take place regardless of the weather. In extreme weather conditions, the tour may be adapted at the request of the participants. For example, it may take place largely in shaded areas during hot weather, or it may be relocated to a dry area during heavy rain.
4.3. Definition of the services offered:
4.3.1. Tours
Wiener Nimmerland offers city tours led by people who have previously experienced addiction and homelessness. Each tour is based on personal experiences and is unique in its route and design. A current overview of all tours can be found on the website.
All tours take place outdoors and are on foot from station to station
4.3.2. Addiction prevention lectures
Wiener Nimmerland also offers lectures on addiction prevention. These take place on-site at the booked school or facility and are delivered by former addicts who share their own experiences.
5. Vouchers
5.1. Tour vouchers can be purchased online via the website, by phone, or by email. A voucher can be created for multiple people at once. The customer will receive the voucher along with the invoice via email and can pay by bank transfer or PayPal.
5.2. Wiener Nimmerland vouchers are valid for 6 years.
5.3. Tour vouchers are valid for a specific number of participants and can be redeemed for all offered tours. Upon purchase, the customer selects the desired number of participants; prices are based on the respective group size. Any discounts or promotions are automatically applied. The recipient can then freely choose any tour and a suitable date.
6. Liability
6.1. Wiener Nimmerland is liable for the proper provision of the contractually agreed services.
6.2. Wiener Nimmerland is not liable for unplanned interruptions or delays to the tour if these are beyond our control (e.g., weather, sudden construction work, police intervention). In such cases, the tour guide reserves the right to adjust the route or, in extreme cases, cancel the tour if safe completion is not possible.
6.3. The tours take place on public roads, mostly asphalt, through parks and over stairs (which can be avoided at the request of the participants).
6.4. Participation in the tours is entirely at the participant's own risk. Participants must assess and decide for themselves, based on their own (physical) condition, whether they are able to participate in the tour. Any misjudgments are the responsibility of the participant.
6.5. Wiener Nimmerland and the tour guides assume no liability for damages of any kind.
7. Tour start time
7.1. The tour starts promptly at the agreed time.
7.2. For group bookings, the tour guide will wait a maximum of 15 minutes from the official start time. If at least part of the group does not arrive by this time so that the tour can begin, the tour will be considered canceled. No refunds will be issued in this case.
7.3. If the tour guide is more than 10 minutes late, the customer has the choice of continuing to wait, rescheduling, or canceling free of charge. In the event of cancellation, the full amount will be refunded.
8. Rebooking and cancellation conditions
8.1. The customer may rebook, change the number of participants, or cancel the booking free of charge up to 24 hours before the start of the tour. If the cancellation occurs within the last 24 hours, the cancellation fee is 100% of the booking price.
8.2. In the booking confirmation email, the customer has the option to change or cancel their booking independently. The "View/Edit Tour" button redirects them to our website, where they can adjust the number of participants, reschedule the tour, change to another tour, or cancel the tour.
8.3 Rebookings and cancellations can also be made by email or telephone.
8.4. As an alternative to rebooking or cancellation, the customer can request a voucher for the total amount of the booking. This voucher is valid for 6 years [see section 5.2] and can be redeemed for any tour at a later date.
8.5. We reserve the right to postpone or cancel a tour up to three days before the scheduled date. In this case, the customer will be notified immediately and can choose between a free cancellation or an alternative date.
8.6. All tours require a minimum of six participants. If this number is not reached at least 24 hours before the tour date, we reserve the right to cancel the tour. In this case, the customer will be notified in a timely manner and can choose between an alternative date or a full refund of the amount already paid.
8.7. In exceptional cases, we may cancel a tour at short notice on the day of the tour. In this case, the customer may also cancel or rebook free of charge.
9. Choice of Law
9.1. The place of performance of the contract is the place where the tour or lecture takes place.
9.2. The place of jurisdiction is Vienna.
9.3. Austrian law applies to the contractual relationship between the customer and the Wiener Nimmerland.
