for Wiener Nimmerland

For reasons of better readability, the simultaneous use of the language forms male, female and diverse (m/f/d) is avoided. All personal designations apply equally to all genders.

1. General information

1.1. These General Terms and Conditions (GTC) apply to the relationship between the customer and Wiener Nimmerland (contractor or simply called "we/us").

1.2. However, any agreements made between the customer and us may deviate from the General Terms and Conditions. If there are any agreements that deviate from these terms and conditions, this does not result in the invalidity of the entire contract.

2. Booking and conclusion of contract

2.1. Booking a tour from Wiener Nimmerland can be done either through online booking, email or phone call. One of the fixed dates entered or any desired date can be booked. The choice of a desired date is only possible for bookings of at least 4 people.

2.2. A booking will be confirmed by email to the customer within the next 24 hours after receipt of the booking.

2.3. The booking represents a binding contractual declaration.

3. Payment

3.1. Various payment options are available to the customer to pay for the booking. The customer can pay online with credit card, PayPal or with instant transfer via Klarna or EPS. He can also choose an independent transfer or cash payment to pay the costs. In any case, the total costs must be paid no later than 2 weeks after the tour date.

3.2. Payment by credit card is made online directly via our website. To pay with PayPal, Klarna or EPS you will be securely redirected online to the relevant payment provider. Payment by independent transfer is made via your bank.

3.3. If the customer books online via our website, all of them are available in point 3.1. mentioned payment options available. He can pay directly online during the booking process, or opt for bank transfer or cash payment by selecting "Pay later".

3.4. If the customer does not book online but by email or call, the costs must be paid by bank transfer or cash. However, if the customer wishes to pay using one of the online payment functions [see 3.1.], a forwarding to these functions can be sent by email upon request. The button labeled “Pay Now” then redirects to our website https://www.wieernimmerland.at and allows payment with credit card, PayPal, Klarna or EPS.

3.5. The customer decides when booking online, with the payment method "Pay later" for the independent transfer, he will find the relevant data either in the FAQs, on the invoice or they will be sent by e-mail on request.

3.6. The customer must indicate the wish to pay in cash at the time of booking. When booking online, this can be entered in the "Note/comment" field. However, we reserve the right not to accept cash payment.

3.7. An invoice will be issued for companies and schools or otherwise on request. A list of costs can be found in the booking confirmation, the invoice will be created in addition to this.

4. Services

4.1. The scope of the contractually agreed services results from the service description of Wiener Nimmerland. This can be found in full on the website or also stated on the booking page. Since the service can also be booked via TripAdvisor from time to time, there is also a detailed description there. The key data of the booking (date, duration, start and end point) are also included in the booking confirmation.

4.2. The booked activities take place in any weather. In extreme weather conditions, such as over 30°C in the shade or heavy rain and thunderstorms, the tour can be adjusted at the request of the participants. For example, it may take place mostly in shaded areas when it is hot, or moved to a pub or other dry area when it rains heavily.

4.3. Definition of the services offered:

The guided tour takes place outdoors and you move from station to station on foot.

4.3.2. Addiction Prevention Lecture
The lecture will take place on site at the school that has booked.

5. Voucher

5.1. Vouchers can be purchased online on the website, by telephone or by e-mail. The same payment functions are available for payment as when booking a tour [see point 3.], with the exception of cash payment. A voucher can be created for several people at the same time.

5.2. A voucher from Wiener Nimmerland is valid for a period of 2 years.

5.3. Definition of the offered vouchers:

5.3.1. generic gift voucher
The customer selects the number of participants (prices differ according to the category of people) and the respective value is charged. Any promotions or discounts will not be taken into account when purchasing a voucher. The gift recipient can choose any tour date.

5.3.2. Tour voucher (“specific gift voucher”)
In addition to the number of participants, the customer also selects the desired tour (this means choosing between “Tour – German” and “Tour – English”). Any promotions or discounts will be taken into account when purchasing a tour voucher. The gift recipient can choose any tour date.

6. Liability

6.1. Wiener Nimmerland is liable for the proper provision of the service contractually agreed in advance.

6.2. Wiener Nimmerland is not liable for an unplanned interruption or delay in the tour if the reason for this is beyond our control (weather, unexpected construction work, police action). In this case, the tour guide is entitled to change the route of the city tour accordingly, or in extreme cases to interrupt or cancel the tour if it is not possible to carry it out safely.

6.3. The tour leads over public roads and mostly asphalt. It also leads through parks and shortly before the end over a staircase (which can also be bypassed if the participants wish).

6.4. Participation in the tours is entirely at the participants' own risk. The participants must judge for themselves and under their own responsibility and decide whether they are able to participate in the tour based on their own (physical) condition. If these decisions are based on misjudgments, the responsibility for this lies solely with the respective participants.

6.5. Wiener Nimmerland cannot accept any liability for damage of any kind.

7. Tour start time

7.1. The tour starts promptly at the agreed time.

7.2. If the tour was booked by a group, the tour guide is willing to wait for the entire group 15 minutes from the official start time. After that, the tour is considered canceled and no costs will be refunded.

7.3. If the tour guide is more than 10 minutes late, the customer has the choice of waiting for the tour guide, booking another date or canceling free of charge. In case of cancellation, the full amount will be refunded.

8. Rebooking and cancellation conditions

8.1. Up to 24 hours before the start of the tour, the customer has the option of changing the booking to another date free of charge, changing the number of participants or canceling it. If the cancellation occurs after this period, the cancellation fee is 100% of the booking price.

8.2. With the booking confirmation by e-mail, every customer has the option to change or cancel the booking independently [see 8.1.]. In this, the button with the inscription "View/edit tour" redirects to our website https://www.wienernimmerland.at and enables the customer to change the number of participants, the date to any other time [see 2.1 .] to postpone or cancel the tour.

8.3. The customer can also make rebookings or cancellations by phone or email.

8.4. In addition to rebooking and cancellation, there is also the option of requesting a voucher for the total amount of the booking. This is valid for 2 years from the date of issue [see point 5.2] and can be used at a later date to book a tour on any date.

8.5. Wiener Nimmerland has the right to postpone or cancel the agreed tour up to 3 days before the date of the tour. Customers will be informed immediately and can choose between free cancellation or rebooking of the appointment.

8.6. Wiener Nimmerland has the right to cancel a tour on the day of the tour provided no more than 2 participants have booked said date by then. The customer will be informed of this in advance and can choose between free cancellation or rebooking of the appointment.

8.7. In exceptional cases, Wiener Nimmerland is entitled to cancel a tour on the day of the tour. The customer can choose between free cancellation or rebooking of the appointment.

9. Choice of Law

9.1. The place of fulfillment of the contract is the place where the tour takes place.

9.2. The place of jurisdiction is Vienna.

9.3. Austrian law applies to the contractual relationship between the customer and the Wiener Nimmerland.

Martin is is not a trained tourist guide! We offer no conventional tours in which he tells something about the culture and history of Vienna! He shows you no sights and couldn't tell anything about them either!
