For the sake of readability, we have refrained from using masculine, feminine, and diverse language forms simultaneously. All personal designations apply equally to all genders.
1. General information
1.1 These General Terms and Conditions (GTC) govern all contractual relationships between Wiener Nimmerland and the booking customer regarding the offered tours, lectures and other services.
1.2 These General Terms and Conditions may only be deviated from by expressly agreed individual agreements in writing. The validity of the remaining provisions remains unaffected.
2. Services
2.1 The scope of the booked service is determined by the respective service description on the website and by the booking confirmation.
2.2 Definition of the services offered:
2.2.1. Tours
Wiener Nimmerland offers city tours led by people with personal experience of addiction, homelessness, or other social challenges. Each tour is based on personal life stories and is unique in its route and structure.
2.2.2 Lectures
In addition, lectures are offered, especially for schools, educational institutions, companies and organizations, which are given by people with personal experience in the areas of addiction, homelessness or other social challenges.
3. Booking and conclusion of contract
3.1 Bookings can be made via the website, by email or by telephone.
3.2 There are several scheduled public dates available. For groups of 4 or more, an individual date can also be booked.
3.3 After a booking is received, a booking confirmation will be automatically sent by email.
3.4 For Nico's tour, the booking can be cancelled or an alternative date suggested within 48 hours of receipt of the booking.
3.5 Booking a lecture is initially considered an inquiry. After checking availability and feasibility, either a booking confirmation or a cancellation will be sent by email.
3.6 A binding contract is concluded upon receipt of the booking confirmation.
4. Payment and benefits
4.1 Payment can be made by credit card, PayPal, Klarna, EPS, bank transfer, or cash. Credit card payments are processed directly through our website. For PayPal, Klarna, or EPS, you will be securely redirected to the respective payment provider.
4.2 Cash payments must be specified at the time of booking. We reserve the right to refuse cash payments.
4.3 An invoice will be generated for each booking and sent electronically via email. All invoices include statutory VAT unless explicitly stated otherwise.
4.4 Holders of a disability pass or a cultural pass can participate in a tour free of charge. A maximum of two free places are available per tour. Bookings can be made via the website, email, or telephone.
5. Changes, rebookings and cancellations
Tour bookings are services related to leisure activities for which a specific date is agreed upon. Therefore, according to Section 18 Paragraph 1 Item 10 of the Distance Selling Act (FAGG), there is no statutory right of withdrawal. The options for changes, rebookings, and cancellations regulated in this chapter remain unaffected.
The following provisions apply equally to tours and lectures, unless expressly stated otherwise.
5.1 Definitions
5.1.1 A single booking is defined as a tour booking for 1 to 3 people.
5.1.2 A group booking is defined as a tour booking for 4 or more people as well as any lecture booking.
5.1.3 The main season lasts every year from April 1st until and including the last day of school before the start of the summer holidays in Austria.
5.1.4 The off-season lasts from the first day of the summer holidays until and including March 31st.
5.1.5 Regulations regarding increasing or reducing the number of participants apply exclusively to paying participants. Free accompanying persons are not taken into account.
5.2 Individual bookings
5.2.1 Changes, rebookings and cancellations are possible free of charge up to 3 days before the tour date.
5.2.2 Within the last 3 days before the tour date, it is no longer possible to rebook to another date or to change the number of participants.
Invoice and Payment
5.2.3 The invoice will be issued 1 day after the tour has taken place.
5.2.4 The payment term is 14 days from the invoice date.
cancellation
5.2.5 In case of cancellation within the last 3 days before the tour date, 50 % of the total booked price will be charged.
5.2.6 In case of cancellation within the last 24 hours before the tour date or in case of no-show, 100 % of the total booked price will be charged.
5.3 Group bookings in the off-season
5.3.1 Changes, rebookings and cancellations are possible free of charge up to 3 days before the tour or lecture date.
5.3.2 Within the last 3 days before the tour date, the number of booked participants can only be reduced by a maximum of 20. If the number of booked participants falls below the number booked by more than 20 on the day of the tour, we reserve the right to charge 80 participants.
5.3.3 Within the last 3 days before the lecture date, the booked number of school classes or groups can no longer be reduced.
5.3.4 An increase in the number of participants or the number of school classes or groups is possible up until the tour or lecture, provided this is organizationally feasible. Additional participants, school classes, or groups will be charged accordingly.
5.3.5 Within the last 3 days before the tour or lecture date, it is no longer possible to rebook to another date.
5.3.6 A change of the start time on the same day is possible up to 3 days before the tour or lecture date, provided this is organizationally feasible.
Invoice and Payment
5.3.7 The invoice will be issued 1 day after the tour or lecture has taken place.
5.3.8 The payment term is 14 days from the invoice date.
cancellation
5.3.9 In the event of a cancellation within the last 3 days before the tour or lecture date, 50 % of the total booked price will be charged.
5.3.10 In case of cancellation within the last 24 hours before the tour or lecture date or in case of no-show, 100 % of the total booked price will be charged.
5.4 Group bookings during peak season
5.4.1 Changes, rebookings and cancellations are free of charge up to 14 days before the tour or lecture date.
5.4.2 Within the last 14 days before the tour or lecture date, the number of participants booked or the number of school classes or groups booked can no longer be reduced.
5.4.3 An increase in the number of participants or the number of school classes or groups is possible up until the tour or lecture, provided this is organizationally feasible. Additional participants, school classes, or groups will be charged accordingly.
5.4.4 Within the last 14 days before the tour or lecture date, it is no longer possible to rebook to another date.
5.4.5 A change of the start time on the same day is possible up to 3 days before the tour or lecture date, provided this is organizationally feasible.
Invoice and Payment
5.4.6 The invoice will be issued 15 days before the tour or lecture date.
5.4.7 The payment period is 14 days from the invoice date, but no later than before the start of the tour or lecture.
5.4.8 If the booking is made less than 15 days before the tour or lecture date, the invoice will be sent by email one day after booking. The invoice amount must be paid no later than before the start of the tour or lecture.
cancellation
5.4.9 In the event of a cancellation within the last 14 days before the tour or lecture date, 50 % of the total booked price will be charged.
5.4.10 In case of cancellation within the last 3 days before the tour or lecture date or in case of no-show, 100 % of the total booked price will be charged.
6. Minimum number of participants for tours
6.1 A minimum of 8 participants is required for all tours.
6.2 For public fixed dates, all bookings for the same date are added together to determine the minimum number of participants.
6.3 If the minimum number of participants is not reached at least 24 hours before the start of the tour, we reserve the right to cancel the tour.
6.4 In the event of a cancellation, the person making the booking will be informed immediately and can choose between a free cancellation or a replacement date.
7. Tour start time
7.1 The tour begins at the agreed time.
7.2 For group bookings, the tour guide will wait a maximum of 15 minutes from the agreed start time. If at least part of the group has not arrived by then, the tour will be cancelled. In this case, there is no entitlement to a refund.
7.3 If the tour guide is more than 15 minutes late, you can choose between waiting, a replacement date or a free cancellation.
8. Cancellations by Wiener Nimmerland
8.1 We reserve the right to postpone or cancel tours or lectures for important reasons, even at short notice, including on the day of the tour or lecture. This applies in particular in the event of illness of the tour guide or speaker, force majeure, or other unforeseen circumstances that make performance impossible.
8.2 Tours and lectures generally take place regardless of the weather. Typical weather conditions such as rain, cold, or heat do not constitute grounds for cancellation. In the event of exceptional weather conditions that prevent safe execution or travel, a tour or lecture may be postponed or cancelled in accordance with section 8.1.
8.3 In the event of a cancellation, the person making the booking will be informed immediately and can choose between a free cancellation or a replacement date.
9. Vouchers
9.1 Vouchers can be purchased via the website, email, or telephone. They will be sent electronically via email. Payment is accepted exclusively via PayPal or bank transfer.
9.2 Vouchers are valid for 6 years from the date of issue.
9.3 Vouchers are valid for the number of people booked and can be purchased for a specific tour or independently of a tour. Vouchers not tied to a tour can be redeemed for any tour offered within their validity period.
9.4 The payment term for vouchers is 14 days from the invoice date. If payment is not received even after a payment reminder, the voucher will be cancelled and the voucher code will become invalid.
10. Liability
10.1 Wiener Nimmerland is liable for the proper performance of the agreed services.
10.2 No liability is accepted for delays, changes or the cancellation of a tour or lecture due to force majeure or other unforeseeable circumstances.
10.3 Wiener Nimmerland is not liable for services provided by third parties.
10.4 Participation is at your own risk. All participants are responsible for correctly assessing their own physical fitness to participate.
10.5 No liability is accepted for personal belongings.
11. Final provisions
11.1 The place of performance of the contract is the place where the tour or lecture takes place.
11.2 Austrian law shall apply exclusively.
11.3 The place of jurisdiction is Vienna, insofar as legally permissible.
11.4 Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
