For reasons of better readability, the simultaneous use of the language forms male, female and diverse (m/f/d) is avoided. All personal designations apply equally to all genders.
1. General information
1.1. These General Terms and Conditions (GTC) govern the contractual relationship between the customer and Wiener Nimmerland (hereinafter "we" or "us").
1.2. Individual agreements between the customer and us may deviate from these Terms and Conditions. Such deviations do not affect the validity of the remainder of the contract.
1.3. Unless expressly stated otherwise, all provisions apply equally to tours and lectures.
2. Booking and conclusion of contract
2.1. Tours with Wiener Nimmerland can be booked online, by email, or by phone. Fixed dates are available. For groups of four or more people, a customized date can also be booked.
2.2. For Nico's tour, the booking is initially considered a request. After checking availability, the date will be confirmed. Within 48 hours of receiving the request, the customer will receive either a booking confirmation, a cancellation, or a proposed date change via email.
2.3. For Martins Tour, the customer will automatically receive a booking confirmation by email after booking.
2.4. Lectures can be requested online, by email, or by phone. They are aimed at school classes and groups and can be booked for multiple classes at once. Billing is per school class.
2.5. Booking a lecture initially constitutes a request. After checking the availability of the speaker and the suitability of the venue in terms of distance, the customer will receive a confirmation or cancellation via email.
2.6. A binding contract is concluded upon receipt of the booking confirmation.
3. Payment
3.1. Various payment options are available to the customer: credit card, PayPal, instant bank transfer (Klarna or EPS), independent bank transfer, or cash payment.
3.2. The full amount must be paid no later than two weeks after receipt of the invoice.
3.3. Payment by credit card is made directly through our website. For payments via PayPal, Klarna, or EPS, the customer is securely redirected to the respective payment provider. Independent transfers are made via the customer's bank.
3.4 Cash payments are generally possible, but must be indicated at the time of booking. We reserve the right to refuse cash payments.
3.5. For each booking, an invoice will be automatically generated and sent via email after the tour has been completed. Upon request, the invoice can be provided in advance.
3.6. Holders of a Culture Pass can participate in one tour free of charge. A maximum of two places are available per tour. Bookings are accepted via the website, email, or phone.
4. Prices and sales tax
4.1. As of January 1, 2026, Wiener Nimmerland is subject to VAT. All prices quoted from this date onwards include statutory VAT, unless explicitly stated otherwise.
4.2. For tours and lectures booked and paid for up to and including December 31, 2025, our previous prices excluding VAT apply. From January 1, 2026, the new prices including VAT will automatically apply.
4.3. The payment obligation arises upon booking or booking confirmation and must be fulfilled in accordance with the "Payment" section. Invoices will be issued with VAT shown separately from January 1, 2026.
5. Services
5.1. The scope of services is defined in the service descriptions provided by Wiener Nimmerland, which are fully available on the website and the booking page. The booking details are also provided with the booking confirmation.
5.2. Definition of the services offered
5.2.1. Tours
Wiener Nimmerland offers city tours led by people who have previously experienced addiction and homelessness. Each tour is based on personal experiences and is unique in its route and design. A current overview of all tours can be found on the website.
All tours take place outdoors and involve walking from station to station.
5.2.2. Addiction prevention lectures
In addition, Wiener Nimmerland offers lectures on addiction prevention, which are given by people who have previously suffered from addiction and who share their own experiences.
The lectures will take place on-site at the booked school or institution.
6. Rebooking and cancellation conditions
6.1. General rebooking and cancellation conditions
6.1.1. The customer can reschedule, change the number of participants, or cancel the booking free of charge up to 24 hours before the tour begins. If the cancellation is made within the last 24 hours, the cancellation fee is 100% of the booking price.
6.1.2. For group bookings, the customer generally has the option to flexibly adjust the number of participants to the actual group size up to the tour date, unless special regulations apply as in April, May and June (see point 6.2).
6.1.3. In the booking confirmation email, the customer has the option to change or cancel their booking independently. The "View/Change Tour" button redirects to our website.
6.1.4. Rebookings and cancellations can also be made by email or telephone.
6.1.5. As an alternative to rebooking or cancellation, the customer can request a voucher for the total amount of the booking. This voucher is valid for six years [see section 8.2] and can be redeemed at a later date for any tour.
6.1.6. We reserve the right to postpone or cancel a tour up to three days before the scheduled date. In this case, the customer will be informed immediately and can choose between a free cancellation or an alternative date.
6.1.7. A minimum of six participants is required for all tours. If this number is not reached at least 24 hours before the tour date, we reserve the right to cancel the tour. In this case, the customer will be informed immediately and can choose between a free cancellation or an alternative date.
6.1.8. In exceptional cases, we may cancel a tour at short notice on the day of the tour. In this case, the customer can also cancel or rebook free of charge.
6.2. Special seasonal regulations for tours and lectures from April 1st to the beginning of July
6.2.1. Due to high demand, special regulations apply to all tours and lectures taking place between April 1st and the last day of school before the summer holidays. These regulations ensure planning security, allow for fair scheduling, and take into account our limited capacity during the peak season.
6.2.2. Bookings can be cancelled, rebooked or the number of participants adjusted free of charge up to eight days before the event.
6.2.3. Free cancellation is no longer possible within the last seven days before the appointment. The cancellation fee during this period is 100% of the booking price.
6.2.4. Rescheduling is no longer possible within the last seven days before the tour or lecture.
6.2.5. Within the last seven days before the tour date, the number of booked, paying participants can only be reduced by a maximum of 20%. Accompanying persons are exempt from this rule.
6.2.6. If the number of participants agreed upon no later than eight days before the tour date falls short by more than 20% on the day of the tour, we reserve the right to charge at least 80% of the booked participants, regardless of their actual attendance.
7. Tour start time
7.1. The tour starts promptly at the agreed time.
7.2. For group bookings, the tour guide will wait a maximum of 15 minutes from the official start time. If at least part of the group has not arrived by then, the tour will be considered cancelled. A refund is not possible in this case.
7.3. If the tour guide is more than 10 minutes late, the customer has the choice of waiting, rescheduling, or canceling free of charge.
8. Vouchers
8.1. Vouchers for tours can be purchased online via the website, by telephone, or by email. One voucher can be issued for multiple people at the same time. The customer receives the voucher along with the invoice by email and can pay by bank transfer or PayPal.
8.2. Vouchers from Wiener Nimmerland are valid for 6 years.
8.3. Tour vouchers are valid for a specific number of participants and can be redeemed for all tours offered.
9. Liability
9.1. Wiener Nimmerland is liable for the proper performance of the contractually agreed service.
9.2. Wiener Nimmerland is not liable for delays, changes, or cancellations due to force majeure or unforeseen circumstances, such as extreme weather conditions, police operations, or construction work. The booked activities generally take place regardless of the weather.
In such cases, the tour guide or speaker is entitled to adjust or, in extreme cases, cancel the tour.
9.3. The tours lead along public paths, mostly asphalt, through parks and over stairs (which can be bypassed at the request of the participants).
9.4. Participation is entirely at the participant's own risk. Participants are responsible for accurately assessing their own physical fitness to participate.
9.5. Wiener Nimmerland and the tour guides employed assume no liability whatsoever for damages of any kind.
10. Choice of Law
10.1. The place of performance of the contract is the place where the tour or lecture takes place.
10.2. The place of jurisdiction is Vienna.
10.3. Austrian law shall apply exclusively.
